Defendant No. 8 http://activerain.com/blogsview/1771030/defendant-no-8 http://activerain.com/blogsview/1771030/defendant-no-8 Thu, 29 Jul 2010 17:31:00 +0000 This past Tuesday I had an interesting day.  I was known as "Defendant No. 8."  This is how one is referred to when appearing on the Judge Joe Brown show.  Plaintiff No. 1, Defendant No. 5, etc.  My case was the 8th of the day . . . hence, Defendant No. 8. Not sure if "fun"  is the way to put it, but when Todd (associate producer) called to ask if I would appear, I immediately said . . . NO!!  Then, after several days of mulling it over, I relented.  I knew my case was strong, even though a named defendant.  I was in the right, but would Judge Joe Brown rule in my favor? (Photo courtesy of Wikipedia.org)   The fact that Defendant No. 8 prevailed is beside the point.  What was fascinating was how Judge Joe Brown works his show.  Standing before him he talked for 40 minutes . . . and yet, to me, the time flew by.  And I mean that.  I was standing before a great Orator . . . the epitome of that word.  I felt I was  listening to a Greek philosopher of ancient times.  I can only imagine, back in the day, when technology hadn't been invented, the spoken word which was so celebrated and used as a form of teaching, influence and entertainment . . . was an art form.  And Judge Joe Brown has this art form -- public speaking / oration -- down pat.  It was amazing for me to listen to him. I imagine that there has to be edits made to make for good TV.  Hmmm . . . What makes for good TV in an unscripted format??  Well, for one thing, having wonderful dialouge to go through.  And that's when you get a great orator.  It was an honor for me to listen to Judge Joe Brown give his orations.  His ability to discourse in public speaking is bar none.  Yes, he focused on the case, but went into so much rich information, expounding on "common law," the obligations of a landlord, which he then gave me quite a compliment and stated, "Landlady." He acknowledged me as a Realtor® and commented about the nature of the current market, the hardships of many.  If only you could have been there with me.  You would have felt the same admiration I have for this man.  He truly is a genuine individual who understands the depths of issues that afflict and affect people.  He understands, with his heart, and his spirit -- and then -- his Orations.  OMIGOSH!!  From his deep understandings he voices his concerns, positions, and beliefs with such convictions and resolute knowledge. It was a real honor for me.  Again -- not because Defendant No. 8 prevailed.  I could have stayed here, gone to small claims court and got the same results (I had a strong hand, wink).  But to listen to Judge Joe Brown orate . . . truly beautiful to listen to. Most people have a hard time understanding Shakespeare's plays.  I akin Judge Joe Brown's discourse, his orations to be on that grand scale . . . combined with the Greek philosophers' of ancient past.  Like a play written by Shakespeare, and the speeches made by Socrates, the art of the spoken word flowed so effortlessly from Judge Joe Brown.  The people in audience are paid to be there.  I hope they can appreciate the level of intellect they are getting paid to hear.  I felt the audience should be law students.  They would certainly gain some very good legal perceptions, and similar to the time of ancient Greek philosopher's, the would be seated at the foot of a great Orator!! To be sure, Portland is tops on livability- if you are employed and making a good median wage for your profession. You can reinvent yourself, and newcomers have high levels of education. The farming sector is thriving here, and enjoy excellent support. We have a direct connection to Asia and Europe, and are enjoying modest investments from German and Scandinavian countries. We have Mayor Adams, who is devoted the city and has taken the mantle of responisbiliy for the metro area. To incorporate and start a business here is quick, efficient and of low cost. Environmental responsibility is very key here, with people walking the walk instead of merely talking about it. However, wages are low, outright stagnant in some cases. The cost of living has risen; and Portland metro area is going a time of very high unemployment. There is a huge disconnect between Portland Metro and the rest of the state that can be contentious, and the city was incredibly unfair to ask working class Oregonians of all backgrounds to fund, via taxes, condo and co-ops for rich while forgoing funding for the schools.Despite these issues, people are happy to be here. I wonder about the issues in the other metros that are listed in Monocle. I've gotten used to seeing the FOR SALE signs in my neighborhood, and even noticed a few 'Auction' signs . . . but now I'm seeing the FOR LEASE signs.  While I live in a residential neighborhood, there is an area of upscale business/office complexes that string along a very large area.  Driving home last evening, I started to count 5 FOR LEASE signs.  Within three blocks, I counted five. That's A LOT!! For EACH sign, that means there's one less SMALL BUSINESS renting/leasing in that business complex.  Perhaps the business moved to another location {wishful thinking.}  Or, perhaps, the business couldn't afford to remain open. When I see FOR LEASE signs I wonder if the owner was forced to lay off employees . . . those employees have got to look for other jobs, go on unemployment, dip into their savings, etc.  Not to mention the owner and/or owners of the company.  They've got a mortgage to pay. In reading Gary Woltal post's, Do You Know What Homeowners Need?  he writes about compassion.  Then, he goes on to write about what might have caused the distressed homeowner to be . . . well . . . distressed! It's NOT only homeownersw who is distressed.  It's the business owner when they can't keep their doors open.  They cut staff, costs, and then when that fails . . . the FOR LEASE sign is posted. I sell new construction, and as the Buyer's Realtor® I never think that just because it's new, it will be perfect. There's a lot of my own stories that come to mind, but I'll let you read this by Andi Grant . . .   Via Andi Grant | Long Beach, Lakewood, Downey CA Real Estate | Prudential 24 HR (310-508-4354 | www.AndiGrant.com):Over 10 years ago before I became a Realtor® in Long Beach, CA, I came across something that utterly shocked me!  While home shopping with a friend in a hilly area of west Los Angeles, we came across a neat row of large model homes.  There was a lot of foot traffic and activity and it looked very festive with balloons and flags as the home builder was celebrating their last phase.  As we parked across the street and got out of the car, we were immediately handed a florescent green flyer by a resident standing in their front yard.  Whoa!  It was a very detailed complaint sheet.  Just behind him lodged in a picture window was a matching large florescent green poster stating in handwritten letters, "Do Not Buy Ask Us Why!"  I then noticed there were similar posters positioned in the windows of a few nearby homes that faced the model units!  One person even had a flyer box (the kind agents use) on their front lawn filled with what looked to be the same florescent green complaint sheets!  These people were serious!   HELL HATH NO FURY LIKE A HOME BUYER SCORNED! The list detailed what some of the previous home buyers stated as being egregious and flagrant faulty building and cheap products used by the home builder!  This didn't list just a few things, this was a double-sided sheet of paper listing problems that ranged from sparking outlets, entire kitchen islands shaking when the garbage disposal was turned on, to major water leakage from bay windows and even foundational issues! In addition to that, the home buyers in what I guess was a preemptive strike to keep the home builder from claiming the issues as isolated incidents or standard home settling, used a chart listing addresses with a checkmark next to each problem.  I recall seeing more than one issue in which all participating addresses had a checkmark for the same problem. Now thinking back, I can't help but wonder how many of the angry homeowners used a Realtor® and had a professional home inspection performed prior to purchasing?  Were they under the misconception that because it was new it didn't need an inspection?  Did they also forget that the pretty or handsome home sales consultant working in the air conditioned model home office worked for the home builder and seller?  If only they had a Realtor®, a professional property inspection and knew What Questions to Ask A Builder. The Portland Brew Fest was in full swing, but my friend forgot his ID, and they wouldn't let him in.  So we decided to make the best of the day, and thought kicking it in Downtown Portland was second best. Strolling up and down Waterfront Park was nice.  You forget how pretty Downtown Portland is sometimes, when you just rush by in your car. The greed was at the top.  And that greed did compel.  The situation -- and by situtation, I refer to the decline in property values, the foreclosure nightmare of millions, the short sales that go to the wayside, the loan mod fiasco -- isn't complicated.  Not really. If I showed you a glass of water, and asked you what it was, you'd tell me it was a glass of water.  If I asked the Chemist, or Physicist what it was, they'd could say it was a glass of water.  But, they also know how very complicated H2O really is.   2 H2O (l) H3O+ (aq) + OH- (aq) "Water is primarily a liquid under standard conditions, which is not predicted from its relationship to other analogous hydrides of the oxygen family in the periodic table, which are gases such as hydrogen sulfide.  Also the elements surrounding oxygen in the periodic table, nitrogen, fluorine, phosphorus, sulfur and chlorine, all combine with hydrogen to produce gases under standard conditions. The reason that water forms a liquid is that oxygen is more electronegative than all of these elements with the exception of fluorine. Oxygen attracts electrons much more strongly than hydrogen, resulting in a net positive charge on the hydrogen atoms, and a net negative charge on the oxygen atom. The presence of a charge on each of these atoms gives each water molecule a net dipole moment. WATER!!   And for most homeowners -- I like to call them Americans -- they are currently UNDER IT!!    The maniuplations done to each and every mortgage is simple.  They used home owners' deeds of trust as tools.  They used the home owners' property, and their rights to that property, to be sold and auctioned off on the chopping blocks of . . . bonds, MBS (mortgage back securities), hedge funds, derivaties.  They did this without explaining to ANY CONSUMER how that MIGHT -- just MIGHT  -- affect them (us).  Their evil genius plot contaminated the waters of that well. What the chemist/physicist can do is baffle you with the EXPLANTION OF WATER.  It's still: WATER What the financial brainiacs did -- on Wall St., in the Halls of Congress, in the Senate -- was create their blueprint of manipulation, and made if complicated.   Our Government DIDN'T HELP! What I understand is this:  The American homeowner had their rights to property so manipulated that the WATERS were poisoined.  And now we are drowning in it.  The mortgages were manipulated.  The HAMP,  the loan mods, TARP, were tossed out, and only a FEW -- similiar to those on the the sinking ship Titanic -- were able to survive.   Those in "steerage" . . . well, you see what's happening to them.  I wish I was a political cartoonist.  I'd be penning the TITANIC -- the ship built and "billed" as UNSINKABLE "Too Big to SINK".   The life vests that were supposed to be there, were not.  The life boats that were supposed to be there, were not.  The banksters of Wall St., and our Government elect/elite would be saved, watching from a distance in their life boats as the TITANIC sinks, and people drowned. AIG -- "As Lehman Brothers (the largest bankruptcy in U.S. History) suffered a catastrophic decline in share price, investors began comparing the types of securities held by AIG and Lehman, and found that AIG had valued its Alt-A and sub-prime mortgage-backed securities at 1.7 to 2 times the values used by Lehman which weakened investors' confidence in AIG. . . .  In the meantime,  New York regulators allowed AIG to borrow $20 billion from its subsidiaries"  READ ABOUT AIG Hmmm AIG LIED and inflated the portfolio values?!?  You don't say.  And because they lied . . .   "AIG was required to post additional collateral with many creditors and counter-parties, touching off controversy when over $100 billion was paid out to major global financial institutions that had previously received  TARP  money. While this money was legally owed to the banks by AIG (under agreements made via credit default swaps  purchased from AIG by the institutions), a number of Congressmen and media members expressed outrage that taxpayer money was going to these banks through AIG In January, 2010, a document known as "Schedule A - List of Derivative Transactions" was released to the public, against the wishes of the  New York Fed."    "Had AIG been allowed to fail in a controlled manner through bankruptcy, bondholders and derivative counterparties (major banks) would have suffered significant losses, limiting the amount of taxpayer funds directly used. Fed Chairman Ben Bernanke argued: "If a federal agency had [appropriate authority] on September 16 [2008], they could have been used to put AIG into conservatorship or receivership, unwind it slowly, protect policyholders, and impose haircuts on creditors and counterparties as appropriate. The "situation" to which he is referring is that the claims of bondholders and counterparties were paid at 100 cents on the dollar by taxpayers, without giving taxpayers the rights to the future profits of these institutions. IndyMac -- "The primary causes of IndyMac's failure were largely associated with its business strategy of originating and securitizing Atl-A loans on a large scale. This strategy resulted in rapid growth and a high concentration of risky assets. From its inception as a savings association in 2000, IndyMac grew to the seventh largest savings and loan and ninth largest originator of mortgage loans in the United States. During 2006, IndyMac originated over $90 billion of mortgages. IndyMac's aggressive growth strategy, use of Alt-A and other nontraditional loan products, insufficient underwriting, credit concentrations in residential real estate in the California and Florida markets, and heavy reliance on costly funds borrowed from the Federal Home Loan Bank (FHLB) and from brokered deposits, led to its demise when the mortgage market declined in 2007. IndyMac often made loans without verification of the borrower's income or assets, and to borrowers with poor credit histories. As an Alt-A lender, IndyMac's business model was to offer loan products to fit the borrower's needs, using an extensive array of risky option-adjustable-rate-mortgages (option ARMs), subprime loans, 80/20 loans, and other nontraditional products. Ultimately, loans were made to many borrowers who simply could not afford to make their payments. Sure, people will read about a particular area . . . which is why Active Rain Localism is a great tool  But why do people move to one particular area over the other?  Is the why do people move answer have anything to do with the best places to live lists, or about more definitive reasons? Paradise - Lucas Cranach 1536 My B.S. degree is in Social Science.  So this type of stuff has always fascinated me.  Although I really screwed up in the statistics component of that degree -- I don't like math -- I did find a good analysis.  The US Census has a table from 2007.  For those of you into this type of thing, you can find the table here:  US Census Reasons for Move (Note: numbers reflected in the chart are in thousands.  Example 543 = 543,000, etc.) Main reasons of why do people move include: New job / transfers To be closer to work / school To establish own household Needed larger home or apartment Wanted better home Why do people move reflected an overwhelming number that "looked at other neighborhood."  Choice of present home had "financial reaons," "room layout/design" and "size" being key factors. This data included owners and tenants, i.e., homeowners and renters.  But, it's still an interesting chart. Maybe the "other" category includes, "I read about this area/neighborhood in a 100 top cities to move to" list.  Who knows . . . There will also be some other adjustments that will be made. In some cases the mortgage lender will repossess the property and is able to sell it to someone else and get it off their books. Another possibility that in some ways is far more troubling is that the financial institution will say, "Oh, we think maybe that property is, um, maybe still worth $2 million. After all, you're making your payments, and so how about if you, the borrower, and we, the lender, hold hands and pretend-" ALISON STEWART:Is this Extend and Pretend? ELIZABETH WARREN:This is Extend and Pretend, that's exactly right. What it really means is we will pretend that this property is still valued where it was back in boom times, and we will simply extend your outstanding mortgage on this property so that you keep paying. In other words, the loan appears to all the world on the books at a high value and fully performing, when the underlying economic reality is that it's worth a whole lot less, and the odds that it will end up in collapse and default, ultimately in foreclosure, are very high. ALISON STEWART:Isn't the idea, though, to give people more time? To give these institutions more time to come up with the money, perhaps hope against hope the economy gets better? ELIZABETH WARREN:Well, that's the question. And you just put it in the right word, it's hope against hope. Here's a problem with it, the longer you pretend, the longer it takes to get the market back to where supply and demand match each other. The longer it takes to get the right price back on the commercial real estate, attract in the businesses, get the rents in the right place, and get this economy back up and booming." (Toward the bottom of the transcript) While they were discussing Commercial properties, quite a few of the loan product that was placed in the Residential arena came from Commercial.  ARM's, for example, had their beginning in the Commercial real estate world.  It wasn't long before they found their way into the Residential marketplace. The funny thing is . . . when I was out this morning, and most likely Deborah was posting her blog, I was actually stopped at the railroad tracks because a large shipment of timbered logs was rolling by.  It happens all the time to me when I'm out . . . being stopped at the RR crossing, and watching car, after car of freshly logged timber roll by. It's very Oregon to see this.  We're a nice, thriving Metro area . . . but the fruits of our State do make their way into the landscape in this manner. Today, I actually had my camera and pulled it out to capture the train.  Very LOCALISM post, I thought, Unfortunately, I thought about nabbing the pic too late (I rarely have my camera with me) and I would have ended up taking a shot of the caboose. When I got back,  I "log" on to Active Rain, and saw Deborah's post! WOW -- that's weird.  I'm sure the logs were en route to DC, where they will be milled . . . and used to print out more money!! Via Deborah Garvin California Mortgage Financing (Security One Financial):So the Financial Reform Bill has passed.  All 2,319 pages of it.  No, I haven't read it...but this post is not about the bill, it's about the PAGES!  I mean, good grief, could we maybe introduce Congress to blogging about their bills and saving it to a disk.....or even a zip file, for goodness sake!! Seriously, and this is not meant is support or defense of any party or segment of government (personal opinions aside), I have questions and I WANT answers.  Which machine to you think is running more in Washington?  Is it the Money Printing Machine?  Could be.  I lost track along time ago about how many "ZERO's" follow the word "Washington".  I do know I think it would help save Carla's Trees if they would start using "Gazillion to the umpteenth power" instead of all those "ZERO's".  And, I am starting to worry that there is going to a shortage on Monopoly Money.  With the holiday season only five months away what is Santa going to do?  Put coal in the Monopoly Game?  I mean, this could get serious.......(REALLY????????) Is the Copy Machine?  Hey, this really has me worried.  2,319 pages copied how many times to how many people?  And, multiply this bill by HAMP, HAFA, FHA reforms, Refi Plus, Home Path., and XYZ bills. I am terrified our country is going to start looking like the destroyed Rain Forest.  I mean, we all know the mortgage industry kills one tree for every loan processed (whether or not it ever funds).  Heck, the underwriter won't even look at a file until it weighs five pounds! What are they doing?  Killing a tree every minute or so?  Is that why there are so many rooms in the White House?  They have to have some place to store the reams of paper?  And, what about Carla's Trees?  Have you ever been to Portland?  It's a wonderfully beautiful city...truth be told the entire Pacific Northwest is worthy of your family vacation.  But, today, I am worried about Carla's Trees.
